This page sets out the general terms in relation to the Services we offer on our website. It is a legal document which is an agreement between TEAMONITE (whom we refer to as “we”, “our” and “us”) and the Customer (referred to as “you”, “your”, “he”, “she” or the “Customer”).

PRODUCTS AND SERVICES CONDITIONS

1. Selecting Products and/or Services

We have categorised and engineered our products by its possible end use. Nevertheless, you are not limited to this sole end use. By doing so, Teamonite cannot guarantee the functionality and performance of these products with these other end uses.

We have made every effort to display as accurately as possible the colours and images of our products on our website. However, we cannot guarantee that the colour display on the screen of all devices will be accurate.

Price displayed in product view represents a discounted unit price for a minimum of 100 products including VAT and transport, excluding decoration cost.

Prices of our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

2. Designing Products

We guarantee that your designs will not be shared and used for other purposes other than for your orders. All material uploaded on Teamonite’s website by the Customer remains the property of the Customer.

You are responsible for the graphics quality of the designs being uploaded on Teamonite’s website or sent to us by email.

You are accountable for the positioning of all the artworks and text added on the product and it is your responsibility to ensure the correct positioning before validating your order.

We have made every effort to display as accurately as possible the font, graphics and artworks in our design tool. However, we cannot guarantee that the colour display and resolution on your computer monitor will be accurate.

In order to upload designs to Teamonite’s website, you must have the right to use that design. If you are not sure about a design from a third party, please check the status of the design as well as whether or not it is copyrighted. If in doubt, do not upload the design to Teamonite to avoid any problems from the rightful owner of the design. Please note that illegal use of known brands and labels is a violation of the rights of the respective owners.

You represent and warrant to Teamonite that you have all necessary rights, including but not limited to, trademark, copyright, privacy rights, publicity rights to use the text or design without violating the rights of any third party. Teamonite may, in its sole discretion, refuse to print any designs or text that you submit. However, Teamonite is not obligated to review any of your submissions.

Should any of these rights be violated, Teamonite will not take any responsibility. You will be held solely responsible for any misuse of third-party designs, images, or anything that you do not have the right to print or use.

You hereby agree to indemnify and release Teamonite from all liability for claims relating to the alleged or actual infringement of any third-party rights and any law to the extent that such claims relate to your use of Teamonite’s website and service.

You are fully accountable for any artwork uploaded or text added on the design tool and Teamonite will not be held responsible at any time if you violate the Terms of Service. Teamonite is not obligated to review any of your submissions.  However, we reserve the right to conduct a special review for racist, politically and individually discriminatory text content and reject the product order accordingly.

Prices displayed in the design tool corresponds to unit price of 1 product; the cost of decoration will be included as and when artworks are added and volume price will be adjusted once order quantity has been specified.

Prices of our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

3. Adding Products and Services to Cart

Our Size chart has been defined to facilitate the selection of products. It is your responsibility to refer to the size chart to ensure that your requirements are met.

Once you have added products in the cart, we recommend that you conclude the purchase at the earliest as we cannot guarantee that products will be available in the size and colour selected.

4. Confirming the Order

We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

It is your responsibility to ensure that you have ordered the correct size, quantity and colours of each product upon confirmation of the order.

5. Completing Payment

Production will begin only when payment has been received and confirmed. Requests for changes or additional customisation or alterations cannot be made after payment.

The prices stated when the order is placed shall be valid. All price information provided includes the applicable statutory amount of value-added tax.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities ordered per person, per company or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made on our website such as billing and shipping address, email address, phone number, BRN and VAT number for companies so that we can fulfill your order.

6. Delivering the Order

All products shall be dispatched once payment has been received and confirmed in accordance with the above policies, and production is complete.

A delivery fee of Rs 250 is applicable on all orders up to Rs 15,000. For orders above Rs 15,000, we offer FREE delivery in Mauritius within 10 to 12 working days for quantities up to 300 pieces (Effective as from 5th May 2022).

Once the order is ready to be delivered, Teamonite will inform the customer on a date and estimated time of delivery. Teamonite assumes no responsibility for delays attributable to the fact that customer is not reachable by phone or not present to receive goods at any given address or due to any force majeure.

In the event Teamonite cannot deliver the order after two attempts, the customer will be requested to either pick up the order at Teamonite’s Premises or pay an additional fee of Rs 500 for each attempt in respect of any subsequent delivery.

We endeavour to keep in stock sufficient quantity of products in every colour as available on the website.  Should the selected product not be available at the time an order is placed, Teamonite shall notify the customer within 24 hours of the order confirmation and propose alternatives. If both parties do not come to an agreement; you may please refer to Cancellation and Refund Policy below for more information.

An option of “Need Next Day Delivery” (currently unavailable) is available with a limited range of products and decoration type. Thus, you can only request for the next day delivery (currently unavailable) option for these limited products at an extra delivery fee of Rs 600.

7. Post-Delivering the Order

At Teamonite, all necessary precautions are taken to produce your order as per your specifications from the moment we receive your request up to delivery. If you receive the products that differ materially from what you created/ordered or the base product is faulty, please contact us at contact@teamonite.com or 2068989 without undue delay but not later than 14 days of receiving your order. Our customer service will respond to you within 2 working days to find a mutual agreement. The customer may do so, provided the products are unused and returned in its original packaging.

DELIVERY AND CANCELLATION/REFUND POLICIES

1. Delivery Policy

This delivery policy governs the delivery of any items you purchase through Teamonite website. This delivery Policy is subject to the Terms of Service for the Teamonite website on which you made your purchase.

We fully manage and operate the delivery process ourselves without the involvement of any third party service.

We will only process your order after reception of payment. Your order will be delivered within 10 to 12 working days or within 24 hours for some specific products for quantity up to 300 pieces as from the payment received date. In no event will Teamonite be responsible for delays in delivery due to natural calamities, governmental acts or any other situations beyond our control.

Teamonite will only accept delivery to a valid street address in Mauritius. We do not deliver to P.O. Boxes, or local Post Office. Teamonite reserves the right to request a change in delivery address if that given by the customer is found to be unsafe for delivery.

Teamonite will inform you of the delivery schedule by contacting you on the telephone number you provided in your contact details. It is the responsibility of the customer to ensure that the appropriate person has been assigned to receive the order at the time scheduled.

In case Teamonite cannot deliver the order after two attempts, the customer will be requested to either pick up the order at Teamonite Premises or pay an additional fee of Rs 500 to schedule the third delivery.

Teamonite will always deliver the goods against a signature on the delivery receipt acknowledging acceptance and reception of the order. Teamonite will not be accountable for any loss or damages caused after delivery. Both Teamonite and the customer will have in possession a copy of the delivery receipt as proof of delivery.

Teamonite will always deliver a full order at one time. Partial delivery is not applicable unless under exceptional circumstances and as may be mutually agreed by the parties.

 

2. Cancellation/Refund Policy

Teamonite commits to review each request for cancellation and/or refund and contact the customer to agree on the way forward.

2.1 Cancellation by Customer

Subject to the below provisions, the Customer has the right to cancel its order.

Customised Orders

Teamonite is an online shop selling customised and tailor-made products, thus the right of withdrawal from the customer does not apply. Examples include:

  • pre-produced goods that are decorated as per online design made by the customer.
  • goods that are tailor-made produced according to specifications or requirements of the customer.

Customised orders are not exchangeable and non-refundable.

Non-Customised Orders

In case non-customised or plain products without decoration are bought, returns may be considered by Teamonite. Such a request must be made within 14 days of delivery. The withdrawal period will expire after 14 days from the day on which you take physical possession of the goods.

To exercise your right of withdrawal, please fill in the attached cancellation/refund form (click to download) and send it to contact@teamonite.com before the withdrawal period has expired.

Once cancellation/refund form acknowledged, Teamonite will contact you to initiate procedures for the reimbursement of payments received from you with a retention fee of 10% of cart value as service fee.

  • If Products not yet delivered to the customer, refund payment will be effected without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
  • If Products already delivered to the customer, we may withhold reimbursement until we have received the goods back in the same conditions as they were delivered to you. The goods must remain unused and returned in its original packaging.

You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You are responsible for the cost of returning the goods. You are liable for any diminished value of the goods which results from your treatment of the goods beyond which is necessary to establish their nature, characteristics and functionality.

All reimbursement will usually be carried out using the same means of payment as you used for the initial transaction. We reserve the right to decide on the final means of payment for reimbursement. For each cancelled order whereby order has been processed, the customer will be charged a fee of 10% on the purchased amount.

2.2 Cancellation by Teamonite

Teamonite also reserves the right to cancel or limit any order under specific conditions. The customer will be notified of such cancellation as soon as possible and will be eligible for a full refund.

We will not be held responsible for any delay or failure to comply with our obligations under these Terms of Service if the delay or failure arises from any cause which is beyond our control, including but not limited to, an event of force majeure.

No liability of any nature whatsoever shall be incurred by Teamonite on the happening of a force majeure or any such events as aforesaid. In this Clause 2.2, an event of force majeure includes but not limited to:

  1. An act of God (such as, but not limited to, fires, explosions, earthquakes, drought, tidal waves and floods);
  2. Machine breakdown;
  3. A riot, commotion, strikes, go-slows, lockouts or disorder; or
  4. acts or threats of terrorism.
